Tamil Nadu Government Files Lawsuit Against Union Government for Withholding Relief Funds

Tamil Nadu Government ने Union Government के Against Supreme Court में एक Original Suit File किया है, जिसमें Claim किया गया है कि Union Natural Calamities के लिए Relief Funds रोक रहा है। Constitution के Article 131 के तहत दायर State की Plea में Court से Union Government को हाल की बाढ़ और चक्रवात माईचुंग से हुए नुकसान के लिए 37,000 Crore Rupey से अधिक की सहायता प्रदान करने का निर्देश देने का अनुरोध किया गया है।

राज्य December 2023 में Cyclone ” Michaung” से हुए नुकसान के लिए 19,692.69 Crore Rupey और December 2023 में Tamilnadu के Southern District में Unprecedented Extremely Heavy Rainfall से हुए नुकसान के लिए 18,214.52 Crore Rupey की Financial सहायता (Assistance) चाहता है।

State Government Interim Relief के लिए एकपक्षीय Order चाहती है, जिसमें Union को Interim उपाय के रूप में State को 2000 Crore Rupey की राशि जारी करने का Instruction दिया जाए। State ने अनुरोध किया कि Interim Relief Chief Minister द्वारा दिनांक 19.12.2023 को दिए गए अभ्यावेदन और दिनांक 10.01.2024 को Chief Secretary द्वारा Relief कार्यों और Temporary बहाली कार्यों को चलाने के लिए interim Help की मांग के Base पर की जाए।

Suit में Claim किया गया कि Reports पर कार्रवाई करने और Tamil Nadu को Financial Help जारी करने का Decision लेने में Government of India की Failure स्पष्ट रूप से ” illegal, मनमानी है। साथ ही Indian Constitution के Section 14 और 21 के तहत Citizens के Fundamental Rights का violation करती है।” कई Appeals के बावजूद, Government of India ने Cyclone Michong की Twin Disasters और Southern Districts में Unprecedented Rains और Floods से Relief और Recovery के लिए National Disaster Response Fund (NDRF) से Tamil Nadu को कोई धनराशि प्रदान नहीं की।

Plaintiff का तर्क है कि NDRF से Relief Fund को Approve देने और Tamil Nadu को धन जारी करने के लिए High Level Committee की बैठक बुलाने में Home Ministry द्वारा अनुचित देरी हुई, जिससे इसके Affected Citizens के लिए State के Development में बाधा उत्पन्न हुई, Mental Distress हुई और कठिनाई हुई, जो Relief उपायों की प्रतीक्षा कर रहे हैं। Plaintiff का कहना है कि यद्यपि Inter-Ministerial Central Teams की Reports पर चर्चा करने के लिए 15.3.2024 को National Executive Committee की Sub-Committee की बैठक आयोजित की गई। Home Minister, Agriculture Minister जैसे Key Members वाली high-level committee Finance Minister और NITI Aayog के Vice Chairman को अभी Meeting कर इस Case पर Deccision लेना है।

Lawsuit में 15वें Finance Commission का भी उल्लेख है, जिसने 2021-2022 से 2025-2026 की Period के लिए National Disaster Response Fund Allocated की, जिसमें Severe Disasters की स्थिति में Additional Financial सहायता भी शामिल है। Plaintiff का दावा है कि Guidelines और National Disaster Management Act 2005 के According सभी Necessary Formalities पूरी कर ली गईं। इसलिए Tamil Nadu को Funds Distribut करने में Delay करने का कोई Valid Reason नहीं है।

Plaintiff का Argue है कि Experts, Inter-Ministerial Central Teams और National Executive Committee की Sub-Committee के आकलन के बावजूद, NDRF Funds Release नहीं करने के लिए Government of India द्वारा Tamil Nadu के साथ Unfair Treat किया जा रहा है। Plaintiff का Argue है कि यह Differential Treatment, Class Discrimination के बराबर है। कुछ States को दूसरों के मुकाबले Preference देकर National Disaster Management Policy, Financial Relations और Tax Apportionment की Federal Nature का Voilate करता है।
