Supreme Court’s decision: The tenant will have to be compensated for the ‘interim benefit’ even after the rights are terminated
Supreme Court ने कहा कि यदि किरायेदारी (Tenancy) Rights समाप्त होने के बाद भी किराएदार किराए के परिसर में बना रहता है तो Land lord किरायेदार से ‘Interim Benefit’ के रूप में Compensation पाने का हकदार होगा।
Justice JK Maheshwari और Justice Sanjay Karol की Bench ने कहा, “जबकि उपर्युक्त स्थिति आमतौर पर Accept की जाती है, यह कानून के दायरे में भी है कि Renter, जो एक बार Valid form से Property में प्रवेश कर गया, अपने Right समाप्त होने के बाद भी Occupations में बना रहता है, वह Occupations के Right समाप्त होने के बाद उस अवधि के लिए Land Lord को Compensation देने के लिए उत्तरदायी है।”
Supreme Court के सामने यह सवाल आया कि क्या किरायेदार Land Lord को ‘Interim Benefit’ के रूप में Compensation देने के लिए Responsible होगा, जब renter के Against कोई बेदखली Order नहीं था, लेकिन वह Rents के परिसर में बना हुआ है। Positive Answer देते हुए Justice Sanjay Karol द्वारा Written Decision में कहा गया कि किरायेदार को उस अवधि के लिए Land Lord को Intermediate Benefits का Payment करना होगा, जब तक वह ‘Tolerant tenant’ रहा हो।
“Tolerant tenant” वह किरायेदार होता है, जो Lawful ownership के द्वारा Land पर Entrance करता है, लेकिन Ownership समाप्त होने के बाद भी उस पर Occupation बनाए रखता है। Court के Anlysis को Indian oil Corporation Limited vs Sudera Realty Pvt Ltd, 2022 (SC) 744 के अपने Decision से Support मिला, जहां यह भी देखा गया कि Leases की समाप्ति के बाद भी Occupation में बने रहने के दौरान Renter Intermediate Benefits का Payment करने के लिए Responsible हो जाता है।
Court ने टिप्पणी की,
“हमारे विचार में ‘determination’, ‘termination’, ‘seizure’ और ‘termination’ Words का Effects, Applicable Facts के equal, subordinate होगा, अर्थात, जब इन तीनों शब्दों में से किसी को भी Leases पर लागू किया जाता है तो lessee/tenant के Rights समाप्त हो जाते हैं या कुछ Cases में उनके weak repetition of previous form में बदल जाते हैं। इसलिए इनमें से किसी भी Situation में intermediate benefit payable होगा।”
Court ने निष्कर्ष निकाला,
“हम Prima facie यह राय दर्ज कर सकते हैं कि Defendant-tenant ने अभी तक Unproven causes से Petitioner-Applicant मकान मालिक को Rent Payable और/या अन्य Outstanding Amount के Payment में देरी की है। Property से मिलने वाले Monetary benefits से Refuse करना, जब Record का हिस्सा बनने वाली Discounted Market Report के संदर्भ में देखा जाता है तो Undoubtedly Enough है। इस तरह Reasonable exceptions के अधीन हम Petitioner-Applicant द्वारा दावा की गई Deposit amount करने के लिए यह Order Pass करते हैं, जिससे Parties के बीच ensure complete justice हो सके।”
