Supreme Court Rejects Plea to Bring Back Sufi Leader’s Remains for Reburial in India

Supreme Court ने Friday को Sufi Leader Hazrat Shah Muhammad Abdul Muqtadir Shah Masood Ahmad के अवशेषों को खोदकर वापस लाने और उन्हें Re-burial के लिए Dhaka से India लाने की Appeal reject कर दी।

Chief Justice of India (CJI) DY Chandrachud, Justice JB Pardiwala और Justice Manoj Mishra की Bench ने Clear किया कि किसी Foreigner के शव को India वापस लाने का कोई Legal या Constitutional Right मौजूद नहीं है।

Sufi Leader Pakistan चले गए थे और 1992 में उन्होंने Pakistani Citizenship हासिल कर ली थी। वह एक Ceremony के लिए Bangladesh में थे जब उनका Demise हो गया और उन्हें Dhaka में Bury गया।

” Hazrat एक Pakistani Citizen थे और इस Appeal पर विचार करने का Claim करने का कोई Constitutional रूप से लागू करने योग्य Right नहीं है। उन्हें वर्तमान में Dhaka में दफनाया गया है जहां उनका Demise हो गया। पहले Principle के रूप में यह Court ऐसे Person को निर्देश नहीं दे सकती जो Foreign Citizen है पुन: Bury के Ceremony के लिए India लाए जाने का कोई Right नहीं है,” CJI ने Appeal Dismiss करते हुए टिप्पणी की।

Petition Dargah Hazrat Mulla Syed, Prayagraj ने File की थी।

Dargah के Counsel ने कहा कि Deceased को उसका Sajada Nasheen (Successor या Hereditary Administrator जो Sufi Dargah के Custodian या Trustee के रूप में कार्य करता है) नियुक्त किया गया था।

” Sajada Nasheen के लिए, Person को Dargah के परिसर में ही दफनाया जाना चाहिए। उसका Pakistan या Family में कोई Follower नहीं है। वह यहां Dargah का Sajada Nasheen है। उसकी Grave को यहां उचित रूप से समर्पित किया जा सकता है। Aircraft के Rules भी Citizen और Non Citizen के बीच Differentiation की allow न दें।”

हालाँकि, Court ने पूछा कि शव को कौन खोदेगा।

“अब इसे कौन Exhume करेगा?”

यह Eventually Appeal को Dismiss करने के लिए आगे बढ़ा।
