Supreme Court Issues Notice to NTA on Petition Seeking Cancellation of NEET 2024 Due to Alleged Paper Leak
Supreme Court ने Tuesday (11 June) को Center और National Testing Agency (NTA) को Petition पर Notice जारी किया। उक्त Petition में कथित Paper Leak के कारण Under-Graduate (UG) Medical Course के लिए इस साल आयोजित National Entrance-cum-Eligibility Test (NEET) रद्द करने की मांग की गई।

Justice Vikram Nath और Justice Ahsanuddin Amanullah की Vacation ने NTA से जवाब मांगते हुए Case को 8 July के लिए Post किया।
Justice Amanullah ने NTA का Representation करने वाले वकील से कहा,
“यह इतना आसान नहीं है कि क्योंकि आपने ऐसा किया है, इसलिए यह Pure है। Purity Effect हुई है, इसलिए हमें जवाब चाहिए। आपको कितना Time चाहिए? Court के फिर से खुलने पर तुरंत? अन्यथा, Counselling शुरू हो जाएगी।”
NTA के वकील ने कहा कि Petition को पहले की Petition के साथ Attach किया जाना चाहिए, जिस पर 17 May को chief justice of india (CJI) की अध्यक्षता वाली Bench ने Notice जारी किया। उन्होंने बताया कि वह Petition 8 July को Listed है। इसके बाद Bench ने वर्तमान Petition को पहले की Petition के साथ Listed कर दिया, जो 8 July को Listed है।
Petitioners की ओर से पेश हुए वकील Matthews J Nedumpara ने Counselling पर रोक लगाने की मांग की। हालांकि, Bench ने ऐसा करने से इनकार कर दिया।
Justice Nath ने मौखिक रूप से कहा,
“ Counselling शुरू होने दें, हम Counselling नहीं रोक रहे हैं।”
Division Bench ने Order में कहा,
“Notice जारी करें। इस बीच, National Testing Agency द्वारा जवाब दाखिल किया जाएगा।”
Shivangi Mishra और Nine Others ने Result Declare होने से पहले 1 June को Petition File की थी (Shivangi Mishra & Ors. Vs. National Testing Agency & Ors. Diary No. 25656/2024)। Result Declared होने के बाद कई Candidates को Grace Points देने के National Testing Agency के फैसले पर सवाल उठाते हुए Supreme Court में कुछ और Petition File की गईं। हालांकि, Result Declare होने के बाद File की गई Petition को Listed नहीं किया गया।
Constitution के Article 32 के तहत File Writ Petition में Paper Leak के आरोपों के मद्देनजर NTA को फिर से Exam Held करने का Instruction देने की मांग की गई। 5 May को Exams conducted की Purity पर संदेह जताते हुए Petitioners ने Exams cancelled करने की मांग की।
17 May को इसी तरह की राहत मांगने वाली अन्य Petition पर विचार करते हुए Supreme Court ने NEET-UG Exam के Results की Declaration पर रोक लगाने से इनकार कर दिया।
CJI DY Chandrachud की अगुवाई वाली Bench ने हालांकि, उस Petition पर Notice जारी किया और Case को July में Post किया, लेकिन Bench ने कहा कि All India Basis पर Examinations Conducted के Results पर रोक नहीं लगाई जा सकती।
