If the Election Commission Does Not Take Action Against The Use of Religion For Votes, Then it is Doing The Biggest Injustice: Justice KM Joseph
Supreme Court के पूर्व Judge Justice KM Joseph ने Election में Vote पाने के लिए Religion, Race, Language और Caste के इस्तेमाल के Against समय रहते Action करने के भारत के चुनाव आयोग (ECI) के Impotance को Underlined किया।
इस तरह की Identification के Base पर Vote की Appeal करना Law द्वारा निषिद्ध है, Justice Joseph ने कहा कि Election Commission को इस तरह की प्रथाओं के Against Strict Action करनी चाहिए।
Justice Joseph ने कहा,
“Vote पाने के लिए Religion, Race, Language, Caste का Use Prohibited है। Election Commission को इस तरह की प्रथाओं के Against Strict Action करनी चाहिए, चाहे वह कोई भी हो, चाहे वह कितना भी बड़ा क्यों न हो, उसे समय रहते ऐसा करना चाहिए। उन्हें Cases को Pending नहीं रखना चाहिए। यदि वे ऐसा नहीं करते हैं तो वे Constitution के साथ सबसे बड़ा Injsutice कर रहे हैं।”
Justice Joseph Ernakulam के Government Law College द्वारा आयोजित “बदलते India में Constitution” विषय पर National Convention के Opening ceremony में बोल रहे थे।
Justice Joseph ने कहा कि Supreme Court ने 2017 में Abhiram Singh vs C D Komchen Case में दिए गए अपने 7 Judges की Bench के Decision में Representation of the People Act, 1951 की Section 123(3) की Explanation की है। उन्होंने कहा कि Candidate या उसके Opponent या Audience में से किसी के Religion के Base पर Appeal करना वर्जित है।
Justice Joseph ने आगे कहा,
“ Election Campaign में Religion का कोई स्थान नहीं है। Religion की Appeal Facts के Base पर Election Speeches में Use किए गए शब्दों के Base पर तय की जाने वाली बात है। मैं इससे भी आगे जाऊंगा। आपको समझना होगा कि Politician अपनी Limits से बहुत अच्छी तरह वाकिफ हैं। उनके Against Model Code of Conduct और Law दोनों के तहत Action की जा सकती है। मैं कहूंगा कि अगर वे स्पष्ट रूप से या निहित रूप से कोई भी Practice अपनाते हैं,
ऐसा कुछ भी करते हैं, जो तुरंत Religious identity बनाए और उन्हें Vote दिलाए… क्योंकि मेरा मानना है कि Resource उतने ही Important हैं, जितना कि लक्ष्य। Political Power हासिल करना लोगों की सेवा करने का साधन हो सकता है। जिस साधन से आपको Political Power मिलती है, वह शुद्ध होना चाहिए।”
