Firstly, they argued that the insured-appellant, being a body corporate, did not qualify as a consumer under Section 2(1)(m) of the Consumer Protection Act, 1986. Secondly, they contended that the claim was made for commercial purposes, questioning the jurisdiction of the National Commission. The court addressed these objections. Regarding the definition of ‘person’ under the Act, the court emphasized that the Act is inclusive and should be interpreted liberally to serve its beneficial purpose. They noted that the Consumer Protection Act, 2019 amended the definition to include a body corporate, indicating legislative intent to rectify any inconsistencies.
